A guide to Trade Mark Protection in Singapore

If you have a trading name, logo, or brand that you want to protect, you should consider registering it as a trade mark.  A trade mark registration is not only an intangible asset that protects your brand, but also prevents others from using it without your authorisation.

Please note that trade marks are territorial in nature.  A Singapore registration will not protect your brand overseas.  If you plan to expand overseas, we may assist with foreign registration as well.  You may also wish to consider your eligibility under the Market Readiness Assistance Grant for government subsidies.

What is a trade mark?

A trade mark is a badge of origin.  It can take one or more of the following forms :-

  • Word(s) in plain font
  • Graphical element
  • Slogan

Once registered, others cannot use a confusingly similar brand for similar goods or services.

 

Why should I register a trade mark?

A registered trade mark gives you legal rights to:

  • Stop others from using your brand in relation to similar goods or services
  • Entitles you to send a cease and desist letter to infringing parties
  • Build brand value and credibility

This protects your business as it grows.

A registered trademark in Singapore:

  • Is valid for 10 years
  • Can be renewed every 10 years, indefinitely

Your brand becomes a long-term asset.

 

How to register a trade mark in Singapore

  1. Conduct a search of the Trade Marks Register to check if your intended trade mark is available for your intended goods or services.  If other parties have registered similar or identical trade marks before you, we will advise on the options available to you.
  2. If the trade mark is available, file the application with the Intellectual Property Office of Singapore (IPOS)
  3. Respond to objections raised by IPOS, if needed
  4. Upon acceptance by IPOS, the application is published in a Trade Marks Journal for third parties to oppose if they wish.
  5. If no opposition is filed within 2 months of the publication date, you will receive your Certificate of Registration.
